The panel drew on its varied experiences serving as and working with expert witnesses to address both procedural and substantive issues of whether, when and how to retain an expert, including the effect of differing federal, state and local rules regarding experts and what issues are properly subject to expert testimony. The panel examined the differences between consulting and testifying experts, and how those differences bear on the decision to retain an expert as well as the expert’s activities once retained. Finally, the panel addressed best practices when acting as an expert, including whether the rules of professional conduct apply, staying in your lane as an expert rather than counsel, appropriate documentation of your file, and the intricacies of working with retaining counsel who have little or no experience in the T&E field.
