Each panel provides real-world exampAs estate planners, we know the importance of having plans in place that clearly set forth the client’s wishes upon their incapacity or death. But sometimes family members or beneficiaries of the will or trust disagree with those wishes – whether calling into question the distribution of assets, the guardianship of a dependent, or family business succession plans. What drives these disputes, and what can estate planners do to prevent them? How can mediation be used to avoid lengthy and expensive litigation proceedings?
This program explores steps estate planners can take during the drafting process to anticipate and preempt challenges and defend your client’s plans. But because the human element can be unpredictable, it also dives into how mediation can offer an alternative to litigation when disputes do arise. It will particularly discuss the personality-driven approach to mediation, and how understanding and recognizing different personality types and traits can help with reaching settlement at the negotiation table.
